Abstract

Introduction: with the updating of the Organic Comprehensive Penal Code (COIP), the titles that were related to the penalties of crimes related to the drug problem that were typified in the Law on Narcotic and Psychotropic Substances were repealed. Minimal drug use. Methodology: This research has a qualitative and quantitative approach, conducting a thorough bibliographic review, likewise, analytical-synthetic, inductive-deductive, historical-logical, and dogmatic methods were used, in addition to bibliographic review techniques and the application of instruments such as the survey. Results: After the critical analysis, it was justified that although it is true that the table of minimum drug consumption existing in Ecuador aims to differentiate a consumer from a micro-trafficker, violence did increase, since consumption increased and therefore the sale of narcotic and psychotropic substances classified to control. Conclusions: It is concluded that this situation has led to the creation of criminal groups such as the self-proclaimed organized crime groups better known as GDO's. General Area of Study: Law.
