Determinants of administrative management in the bail process in Ecuador

Abstract

Introduction: Bail is a very important part of the criminal justice system, as it allows the release of a person awaiting trial from prison. Objectives: For this reason, the objective of the research is to analyze the determinants of administrative management in the process of applying the bond as an instrument to guarantee freedom in the province of Tungurahua. Methodology: A survey was applied that evaluated the administrative axis (planning, organization, direction, and control) and the bond process from the perspective of legal professionals. Results: The results reflected that in the organizational determinant there must be a commercial bond agent who carries out the payment processes based on the seriousness of the crime. Conclusions: It is concluded that, even though the bond is stipulated as an instrument of exclusion in the Ecuadorian legal framework, there is no pertinent control that evaluates the management axes in the execution of the bond.
